Selling a Luxury Home Off-Market in Portugal
Selling a luxury home off-market in Portugal keeps the property, the price, and the owner’s name out of public view, and lets the price be tested without the stigma of a listing that sits unsold. It works best for distinctive homes in prime locations where the likely buyer is international, qualified, and found through relationships rather than portals.
This applies to owners of prime apartments, villas, and estates in Lisbon, Cascais, Comporta, the Algarve, and similar markets.
The main qualification: a private sale reaches fewer buyers, so it trades some competitive tension for discretion — and some homes sell better with public exposure.
Why owners sell privately
Discretion. A public figure, a family going through a change, or an owner who simply prefers neighbors, staff, and the press not to know.
Security. Photographs of interiors, layouts, and access published on a portal are a gift to the wrong people.
Testing the price. A home marketed publicly for months acquires a history that buyers read as weakness. A private approach lets the price be tested and adjusted without that record.
Control over who visits. Only verified buyers see the property, and only after confidentiality has been agreed.
Timing. An owner who would sell at the right price but is under no pressure can let the market come to them.
When a public listing is the better choice
A private sale isn’t right for every home. A public campaign usually serves better where the property suits a broad buyer pool, where competitive tension matters more than discretion, or where the owner needs certainty of sale within a fixed period.
The decision can also be staged: a private phase first, with public marketing held in reserve if the right buyer doesn’t appear.
| Private sale | Public listing | |
|---|---|---|
| Visibility | Controlled, by invitation | Open |
| Buyer pool | Smaller, pre-qualified | Larger, mixed |
| Price discovery | Through targeted approaches | Through open competition |
| Exposure if unsold | None | A visible listing history |
| Best suited to | Distinctive prime homes, privacy-sensitive owners | Broad-appeal homes, time-sensitive sales |
What a private sale doesn’t change
Off-market describes how buyers are found, not how the property is sold. The legal process is the same: a written mediation contract with the agency, a promissory contract and deposit, and a deed before a notary or other authorized professional. The paperwork has to be just as complete — buyers in private sales are often more demanding, not less.
The seller’s documents
Ready before any buyer is approached. Missing paperwork is the most common cause of a delayed or failed sale.
1. Land registry certificate — confirming ownership and any charges
2. Tax registry record — the property’s tax description and value
3. Habitation license — covering the current configuration of the home
4. Energy certificate — required for the sale
5. Technical file — for homes built or rebuilt after 2004
6. Floor plans — matching what is actually built
7. Condominium declaration — confirming no outstanding charges, for apartments
8. Mortgage position — the amount to be redeemed and any early-repayment costs
9. Records of works — invoices for documented improvements, which can reduce tax on the gain
10. Any leases or occupancy — and when vacant possession can be given
Discrepancies between the registry, the tax record, and what stands on the ground are common, especially with extensions and outbuildings on villas and estates. Resolving them before marketing protects the price.
Pricing a private sale
A credible asking price comes from comparable evidence, not from portal asking prices — and at the top of the market, many of the most relevant comparables were themselves sold privately. A price set too high in a private sale is quieter to correct than a public one, but it still costs time and leaves a trace among the agents and buyers who saw it.
Qualifying buyers
The core of a private sale is who is allowed to see the property.
Proof of funds before an address is shared.
A confidentiality agreement before photographs, plans, or financial details are released.
Identity and source of funds verified, as Portuguese anti-money-laundering law requires of the agency.
Viewings by appointment, accompanied, with the owner’s routine protected.
Tax on the sale, briefly
Gains on Portuguese property are taxed on 50% of the gain at progressive rates, for residents and non-residents alike, with non-residents’ worldwide income used to set the rate. Reinvestment relief applies to residents selling a main home; a 2026 tax authority ruling indicated it does not extend to non-residents. Acquisition costs, sale costs, and documented improvement works from the previous twelve years can be deducted. Your tax adviser should model the position before the price is agreed.

How Luznur Capital sells off-market
Luznur Capital, a trading name of Lusomena Investments, Unipessoal Lda., is a real estate brokerage and advisory firm licensed by IMPIC under AMI 22354 and a registered member of APEMIP.
Pricing from evidence. Comparable sales, including private ones, rather than portal asking prices — and a candid view if the price expected is above what the evidence supports.
A property prepared before it’s shown. Documents gathered and checked, discrepancies identified early, and professional photography and a confidential presentation that never appear on a portal.
Buyers found through relationships. Direct approaches to qualified buyers, family offices, and the advisers who act for them, plus cooperation with agencies in other regions and international partners — so the property reaches serious buyers in Europe, the Americas, and the Gulf without being advertised.
Every buyer verified. Proof of funds and an NDA before the address, identity and source of funds checked as KYC and AML rules require — and the transaction’s other parties verified with the same care.
Viewings handled discreetly. By appointment only, accompanied, with arrival and travel arranged for international buyers where needed.
One point of contact through to the deed. Negotiation, the promissory contract, and completion coordinated with the owner’s lawyer, in English, Portuguese, or Spanish.
Terms in writing. A written mediation agreement, exclusive or not, with the fee agreed at the outset.

FAQ
Can I sell my home in Portugal without listing it publicly?
Yes. An off-market sale approaches qualified buyers directly and privately, without portal advertising. The legal process is unchanged: a written mediation contract, a promissory contract and deposit, and a deed.
Will I get a lower price selling off-market?
Not necessarily. A private sale reaches fewer buyers, which can reduce competitive tension, but it also avoids the price damage of a listing that sits unsold. For distinctive prime homes the right buyer often matters more than the number of viewers.
What documents do I need to sell a property in Portugal?
Typically the land registry certificate, the tax registry record, the habitation license, an energy certificate, the technical file for homes built after 2004, plans, a condominium declaration for apartments, the mortgage position, records of improvement works, and details of any leases.
How are buyers qualified in a private sale?
Through proof of funds before the address is shared, a confidentiality agreement before details are released, and identity and source-of-funds checks as Portuguese anti-money-laundering law requires.
Who pays the agency fee when selling in Portugal?
Conventionally the seller, under a written mediation contract agreed before marketing begins.
How is the sale taxed?
Generally on 50% of the gain at progressive rates, for residents and non-residents, with deductions for acquisition costs, sale costs, and documented improvement works. Reinvestment relief applies to residents selling a main home. Your tax adviser should confirm the position.
